Specific Terms for Sellers
These terms supplement the General Terms and Conditions and apply exclusively to users who publish listings on ZonaCNC as professional sellers.
V.1 Professional status
The seller declares that they are acting within the scope of their business or professional activity. ZonaCNC does not allow private sellers (C2C transactions). Use of the Platform by private individuals is limited to searching and contacting as a buyer.
V.2 KYC verification
ZonaCNC may request from the seller:
- A copy of the business registration certificate or equivalent.
- NIF/EU VAT validated in VIES.
- Certificate of incorporation or equivalent document in their country.
- Bank account ownership certificate matching the invoiced account.
Passing verification is a requirement to access certain plans and to obtain the "Verified Seller" badge.
V.3 Truthfulness and description of listings
The seller guarantees that the advertised machinery exists, is their property or they have the owner's authorization, and is free from undisclosed encumbrances. Technical data (brand, model, year, hours, condition, accessories) must be truthful and verifiable. The seller will be liable for any inaccuracy towards the buyer and third parties.
V.4 Prices and Omnibus consistency
If the seller advertises a "strikethrough" or "reduced" price, the referenced previous price must correspond to the lowest price applied in the preceding 30 days, in compliance with Directive (EU) 2019/2161 (Omnibus Directive).
V.5 Legal obligations of the seller
The seller assumes compliance with:
- Applicable sector regulations: Machinery Directive 2006/42/EC, CE marking, EU declaration of conformity, manuals in the language of the destination country.
- Legal and commercial warranty towards the buyer.
- Their own tax obligations (VAT, withholdings, intra-Community transactions, export).
- Customs and transport unless otherwise agreed.
- Regulations on waste and used machinery where applicable.
V.6 Commissions and payments
As of the date of these terms, ZonaCNC does not charge a commission on sales. The Platform's revenue comes exclusively from subscriptions, featured listings, and ancillary services contracted by the seller.
If a sales commission were to be introduced in the future, sellers will be notified with 30 calendar days' notice, and it will only take effect for transactions initiated after that period.
V.7 Cancellation of subscription and add-ons
Subscriptions (monthly or annual) and add-ons (extra ads, featured listings, boost, reps) are canceled at the end of the current period. There is no proration or refund for the unused portion, except for errors attributable to ZonaCNC or unauthorized charges.
V.8 Delegated sales representatives (Reps)
Sellers with a Pro+ plan can register delegated sales representatives who will receive a copy of the leads received according to the configured filters (province, language). The seller is responsible for the processing of their reps' personal data and the information they access, and must inform them in accordance with Article 13 of the GDPR.
V.9 "Verified Seller" badge and reputation
The badge indicates that the seller has passed KYC verification. ZonaCNC reserves the right to withdraw the badge in the event of fraud incidents, outdated data, or substantiated complaints. Withdrawal is communicated with a reason and a remediation period where possible.
V.10 Suspension and termination
ZonaCNC may suspend or terminate the seller's account with a reasoned notice and a 30-day remediation period, except in the following cases where suspension may be immediate:
- Fraud or attempted fraud.
- Manifest illegality of the content.
- Final judicial or administrative order.
- Repeated breaches previously notified.
The seller has the right to challenge the decision by writing to reclamaciones@zonacnc.com within 30 days of the notification.
V.11 Data return after cancellation
After cancellation, the seller may export their data (account, ads, leads, invoices) for 90 days. After this period, the data will be anonymized in accordance with the Cancellation Policy.
V.12 Ranking parameters
The order in which ads appear in listings is determined by a combination of factors including: textual relevance to the search, location, age of the ad, seller's plan, subscription to a boost service (monthly or permanent), and quality signals (completeness of the listing, photographs, internal rating). The seller can review and discuss the ranking of their ads by contacting reclamaciones@zonacnc.com.
